Below is an abridged interview with Chris Whitt who is the Director of nursing on how the legal and malpractice environment affects the way he and others in the health care marketplace deliver healthcare services.

According to Chris Whitt, malpractice issues like liability costs which can tend to be quite high effectively discourage physicians from perusing specialties which are regarded as high risk and in that regard, there have been fears that in the near future there “shall be shortages of specialists which shall largely inhibit the proper access to care” if nothing is done. However, it is important to note that though Chris Whit notes that the problem is real and growing bigger, Pozgar et al. (2009), argues that such assertions are largely overstated currently.


Further, Chris Whitt continues to note that health care spending has had to be revised upwards as a result of excessive damage awards. However, Chris Whitt notes that a strict legal as well as malpractice environment help uphold professionalism as far as the delivery of healthcare is concerned. In his own words, Chris Whitt states that of great importance is “the United States tort system which as it is currently makes it easy for claimants to access redress for injuries they allegedly sustain to their person, property as or reputation.” However, not everybody agrees with this assertion as this system has been criticized in the past by amongst others Pozgar et al. (2009) who claim that this system is highly costly as well as subjective and with that in mind ends up informing the increase or rising of the cost of health care.
