There are laws that govern the legal authority and the licensing of the companies dealing with private sector. This paper will discuss some of the laws that govern the sector.


When hiring or wishing to obtain a license for the private security services the business with the inclusion of the principals supervisors and the electronic security employees, certification as a private security training school, certification as a compliance agent or instructor, or a private security registration or private security certification should submit to the department completed fingerprint card that is approved by the department. They should also submit an application for the processing of the fingerprints and criminal history conviction information on a form provided by the department. These are then scrutinized by the police department of Virginia.


Before a business license is issued, the application should meet the requirements of licensing and the application submitted to the department.There should a document showing that the applicant of the license has a surety bond in the amount of $100,000 which is executed by the surety company which is authorized to do business in Virginia.


For non residents applying for a license, a form should be completed in an irrevocable consent for the department to serve as service agent for all actions filed in any court.Identification number is then issued to those who qualify for the license by the Virginia state corporations commission for the verification that the entity is authorized to conduct business in the state.


A physical address in Virginia where records required to be maintained by the code of Virginia is kept available for inspection when necessary.The license is then designated according to the type of the private security company one wishes to start. Then a license fee is paid to the department on the separate categories given by the company. After completion of the license application and verification a license can be issued for a period of not more than 24months.


New licenses should be obtained whenever the ownership of the company is changed or the type of the business is changed according to the original business requirements.Licenses are given to legal business identities which are named on the application, whether it is a sole business, partnership, corporation or a legal entity and it remains valid for the named entity.


The licensed entities should comply with the applicable administrative requirements and the standards of conduct and they should not engage in any acts that are prohibited by the Code of Virginia.The licenses can be renewed and the applications should be received by the concerned department 30 days before the license expires.


For a person to apply for certification as compliance agent they should be 18years of age. They should also be citizens of the United States or legal aliens to the country.All the private security businesses are required to maintain administrative requirements and the standards of conduct as determined by the Virginia Code.


The officers of the private security companies should go through a school that is supposed to give them the necessary skills in order for them to be efficient in delivering their duties. These training schools should be governed by regulations which include the following.


The owners and all the others members of the school should conform to the regulations that are provided for in the Code of Virginia. The instructors should be certified. There should be maintenance of files to show the attendance and the electronic images attendance and the master final examination scores. The training schools should not conduct the security services training in a manner that endangers the public health, safety and welfare of the trainee and the public in general.


The officers should not engage in unprofessional acts while in the practice of private security services. Acts of negligence and incompetence are prohibited in the practice amongst the officers. There should also be no false representation or promise to the private security services business client. Officers should not violate any state or local ordinances. All judgments related to private security services should be satisfied.


Differences in limitations of authority associated with private security personnel and public officers

Once the personnel in the private security have undergone the require mandatory trained and succeeded, they have privileges and rights with are sometimes above that of the offices in the public sectors.


Some of the authoritative differences come in connection to the rights in which they are given the Code of Virginia. The security personnel are entitled to arms which they use in their line of duty. They should however use the arms as trained and should not use them to cause arm to innocent citizens.


Officers should be trained on decision making in regard to the use of the arms.It is the responsibility of the personnel in the private security companies to safe guard the public but not to cause harm to them in any way. They are obliged to provide the security services in a professional manner and in ways that are ethically acceptable. The business practices put in practice should be right and in conformity with the Code of Virginia.
