Supreme Court: Skinner v. Switzer

    Skinner was found guilty of murdering the lady who he was in love with in the year 1995. He was sentenced to death by the Supreme Court but on March 26, 1998 he filed a petition on CCA in respect to the act of habeas corpus. Initially the case turned to be untimely and it was dismissed by the Texas courts but the CCA affirmed his case which got some directions for pushing. At the time of placing a petition, he also planned for a DNA tests which were not successive. The oral arguments held by the court on October 13, 2010 mainly focused on the aspect of what the violation of civil rights entails. Although Henry was found guilt of making such kind of murder, he was also entitled to some civil rights which some of the courts were denying him.


Although skinner was denied the aspect of civil right, he managed to go through last on the DNA test which saved him from the death sentence which he had been subjected. American society is being denied their rights by some courts. The U.S. court enabled skinner to pursue a lawsuit so as to come to the actual right of what might have gone wrong. The U.S constitution and their amendments allow individuals to get into their civil rights. In respect to Skinner’s case, he managed to get some evidence on the DNA test which he was initially denied. The main idea of the constitution is to provide just where an individual has the right to provide all evidence that may help him or her prove of innocence.


The Supreme Court milestone relates to the concept of an individual having prosecuted in respect to the committed crime. On the other hand, it a mandate of the Supreme Court to evaluate what the lower courts have ruled and the matter of the case. Supreme Court milestone provides the individual with opportunity to provide any supportive evidence relating to the penalty that the court has passed. The Supreme Court milestone provides a positive and negative impact on the society of the American. The reason behind this is that the defendant or the plaintiff is subjected to the truth where the other party feels oppressed. At the time of this case, John G. Roberts Jr was the chief justice who was supported by justice Ruth Bader Ginsburg to rule against the penalty which has been passed. The ruling that was made favored Skinner although another penalty was passed incase the result concluded that he was guilty.


Ralph I. Lancaster was the presiding president who allowed the case to be directed in a just manner. In the case milestone, the entire reasoning or the idea is to provide just. Although just is provided by giving some more time to provide evidence, certain rules must be followed incase the expected or provided information is not met. The work of the supreme milestone department is to provide justice where it has not been exercised due to various reasons and lack of evidence. The decision in case milestone enables individuals to have justice where one gets the opportunity to provide evidence.
